Terms And Conditions Of The Competition
  1. Information on how to enter and prize details form part of these terms and conditions; however, to the extent that there is any inconsistency between these terms and conditions and any other published material, these terms and conditions will prevail. By participating in this Promotion, each participant fully and unconditionally agrees and acknowledges that these terms and conditions are binding.
  2. The Promoter is Web Mart Pty Ltd, ABN 14 119 431 024 ("Web Mart" or "the Promoter"), ph (02) 8231 6607, 35 Griffin Rd, North Curl Curl, 2099 NSW (trading as 'StockTradingGame.com.au').
  3. The Promotion commences at 10.am Eastern Standard Time ("EST") on 1st February and closes at 4.00pm EST on 30th April 2010 ("the Promotion Period").
  4. This Promotion is comprised of the Trading Competition which is a game of skill and no element of chance plays a roll in determining prizes. Entry into this Promotion is open to Australian residents over the age of 18 years and who submit a valid online entry into the Trading Game. Employees and contractors of the Web Mart Pty Ltd and their immediate families are eligible to enter.
  5. See Schedule 1 for additional terms on how to enter the Trading Game promotion ("the Game"), prize values and how to play the game .The minimum retail value of all prizes offered under this Promotion is $2,000 at time of publication. To claim a prize, Eligible Entrants must be able to provide 100 point of verification and original certified copies must be provided. Price monies will be deposited into a nominated Australian bank account by the winner of that particular prize. Prizes must be taken as offered and cannot be varied. The Promoter has the ability to change/ alter the value of the prizes at any time throughout the promotional period and when such changes are made all entrants in the promotion will be notified via their membership portal.  The Promoter and its related entities accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
  6. The winners of this Promotion (as determined in accordance with Schedule 1) may be liable to declare the prize for taxation purposes and will be liable for any tax payable in respect of a prize. Entrants should seek independent financial advice in relation to any tax payable on the prize and the potential impact on their personal financial situation prior to entering the Promotion.
  7. Except for warranties and conditions implied by law which cannot be excluded, neither the Promoter nor any other member of Web Mart Pty Ltd make any representations or warranties, express or implied, regarding the quality or suitability of any prizes awarded under these terms and conditions. Certain legislation may imply conditions or warranties which cannot be excluded, restricted or modified except to a limited extent. In this event, to the extent permitted by law, the liability of the Promoter and all members of the Web Mart Pty ltd is limited to, at its option: (i) the replacement of the prize or the supply of an equivalent prize; or (ii) the payment, if it does not contravene any law, of the cost of the replacement or supply. To the maximum extent permitted by law, the Promoter and all other members of the Web Mart Pty Ltd expressly disclaim liability for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or for any personal injury which is suffered or sustained in connection with any participant's participation in this Promotion or the acceptance of any prize. The Winners indemnifies the Promoter and all members of the Web Mart Pty Ltd against any liability, injury, loss or damage which may be suffered, incurred or sustained by the Promoter or any member of the Web Mart Pty Ltd arising out of, relating to, or in any way connected with, any act or omission (including negligence) by the Winner, or its use of the prize, or its breach of these terms and conditions.
  8. Nothing in these terms and conditions is intended to exclude, restrict or modify the application of the Corporations Act 2001 and the Trade Practices Act 1974 or any equivalent State or Territory legislation.
  9. The Promoter collects personal information from all participants in order to conduct the Promotion. If the information requested is not provided, the participant may not participate in the Promotion or claim a prize and their entry may be discarded. It is a condition of entry into the Promotion that the Winner consents to the publication of their name and city of origin in any advertisements or articles relating to the Promotion or the prize and participates in any media releases which may include photographs of the Winner by the Promoter or any other member of the Web Mart Pty ltd. By entering this promotion, participants consent to the use of their names and likenesses in this manner. Personally-identifying information collected from participants in this Promotion is subject to the Web Mart’ privacy policies, which can be found at www.Stocktradinggame.com.au/Privacy.php and will be handled in accordance with all applicable laws in Australia.
  10. Entrants can only enter in their own name. The Promoter reserves the right to request an entrant to produce (within the requested time) appropriate identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the entrant's identity, email and/or postal address, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter or the entry has not been verified or validated to the Promoter's satisfaction within the time requested, that entrant's entry will become invalid.
  11. The Promoter is not responsible for any problems or technical malfunction of any computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet.
  12. If this Promotion is not capable of running as planned for any reason (including but not limited to insolvency, excessive costs of operation, failure or malfunction of any computer equipment by reason of infection by computer virus, power failure, bugs, tampering, unauthorized intervention, fraud, or technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and, after consulting with the relevant legislative authorities, to cancel, terminate, modify or suspend the Promotion.
  13. Staff of Web Mart Pty Ltd are eligible to enter the competition, and they are bound by the same terms and conditions as any other entrants in the competition.
  14. Entry into the competition also requires entrants to agree to abide and agree to the general terms and conditions of the site:”www.stocktradinggame.com.au . the Promoter reserves the right in its sole discretion to disqualify any individual who does not operate on the site in accordance with such terms and conditions.   15. Trading Game Rules & Code Of Conduct – Entrants need to abide by the general trading rules of the competition. The Promoter reserves the right in its sole discretion to disqualify any individual who does not operate on the site in accordance with such terms and conditions. See Schedule 2 for details of such Trading Game Rules


 




Schedule 1: Trading Game
To enter the Trading Game promotion ("the Trading Game"), an Eligible Entrant must, during the Promotion Period:
  • Sign up for the Stock Trading Game  online share trading game no later than 15th  February 2010; and
  • Review  the "About the game" instructions found in the website (www.stocktradinggame.com.au)
("Entry into the Game").

No responsibility will be accepted by Web Mart for lost, late, incomplete, illegible, or misdirected Entries into the Game. Only one Entry into the Game per person is permitted. Entrants will only receive one Entry for the first valid Entry into the Game submitted during the Promotion Period. All subsequent entries will be discarded.

Prize Pool: At the end of the game the total prize pool will be allocated to the top five entrants based on their total portfolio value, this being share value plus cash at bank. The split will be as follows:•  
  •  1st-50% of prize pool
  •  2nd-30% of prize pool
  •  3rd-20% of prize pool
In situations where we have joint winners at any one level, the prize pool for that position and the prize pool for positions below (depending on how many joint winners) will be added together and split evenly amongst those entrants. In any event, the decision of Web Mart is final in any prize pool allocation, and entrants have no recourse.

The winning Eligible Entrants will be determined at 5 pm EST on 15th May  2010 at web Mart’s Office, North Curl Curl, NSW:
 (the "Game Winner").

The allocation of the prize to the Game Winner will be final and the Promoter will not enter into any correspondence in relation to the Game Prize or the Promotion.

The Promoter gives no financial, legal, tax or other advice, and takes no responsibility, in respect of trades made during the Promotional Period or as part of the Prize and accepts no liability in this regard.

The Game Winner’s will be notified by telephone and email on 1st May 2010 using the number and address associated with their account. To claim their Game Prize, the Game Winner must respond to the notification in the manner that will be set out over the phone and in the email. Entrants are responsible for keeping the Promoter informed of any changes to their contact information during and immediately following the Promotion Period.

 If the Prize is not claimed by 1st June 2010, the Promoter will then use these funds as they see fit.


Schedule 2: Trading Game Rules and Code Of Conduct

The following outlines the trading rules and general code of conduct around the competition
  1. Entrants start the competition with a virtual starting bank of $400,000 from which they can purchase shares.
  2. Entrants must make at leas 10 trades during the course of the competition to be eligible for prizes
  3. Maximum share holding value on any one stock is $40,000 at initial purchase. Holding value can rise above this if the shares rise in value while the entrant holds shares in the competition.
